RunLife Performance and Physical Therapy: Terms and Conditions of Service

Welcome to RunLife Performance and Physical Therapy ("RunLife"). Please read these Terms and Conditions ("Terms") carefully before utilizing our services. By engaging with RunLife for clinical and/or non-clinical fitness and wellness services, you ("Client" or "Patient") agree to be bound by the following Terms.
1. Nature of Services and Locations
RunLife Performance and Physical Therapy provides both clinical services and non-clinical fitness and wellness services. These services may be conducted online, outdoors, or on-site at various third-party host facilities.
Clinical Services: Physical therapist diagnosis and management of musculoskeletal injuries and/or disorders of the human movement system provided by a licensed physical therapist.
Non-clinical Fitness and Wellness Services: Fitness assessment, biomechanical analysis, performance training/programming and advice, and metabolic testing provided solely for purposes of assessing and improving fitness and performance. These services do not constitute medical advice, diagnosis, or treatment, nor are they provided for the diagnosis or management of disease.
You acknowledge the differences between these distinct services and understand which specific service you are receiving at any given time.
2. Informed Consent and Assumption of Risk
You understand that participating in these clinical services and non-clinical fitness and wellness services involves inherent risks. Many activities intentionally push the cardiovascular and musculoskeletal systems to high levels of exertion.
Inherent Risks: You acknowledge that risks include, but are not limited to, muscle strains, joint sprains, cardiovascular complications (including dizziness, fainting, or abnormal blood pressure), heat illness, and in rare cases, severe medical events. You also acknowledge the inherent risks associated with training outdoors in uncontrolled environments where animals, other persons, motorized and non-motorized vehicles, and other hazards may be encountered.
Voluntary Participation: You confirm that your participation is strictly voluntary and that you are physically capable of engaging in high-intensity exercise and testing protocols.
Duty to Disclose: You agree to alert the practitioner or coach if you experience any pain, dizziness, or any other unusual symptoms prior to, during, or after any session.
3. Waiver and Release of Liability
To the fullest extent permitted by law, you hereby release, waive, discharge, and hold harmless RunLife Performance and Physical Therapy and its owner(s), agents, and representatives, as well as any host facilities, property owners, and their respective directors, officers, employees, and affiliates where services are conducted (collectively, the "Released Parties"), from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by you during or as a result of participation in clinical services or non-clinical fitness and wellness services, whether caused by the negligence of the Released Parties or otherwise.
Furthermore, you agree to indemnify and hold harmless the Released Parties from any and all costs, expenses (including attorneys' fees), or liabilities arising out of your participation in RunLife Performance and Physical Therapy services at any associated host facility.
4. HIPAA, Privacy, and Confidentiality
RunLife Performance and Physical Therapy is committed to protecting your privacy.
Clinical Services: For clients receiving clinical services, your Protected Health Information (PHI) will be handled in accordance with the Health Insurance Portability and Accountability Act (HIPAA). Your PHI will only be used for treatment, payment, and healthcare operations unless you provide written authorization for other uses.
Non-clinical Fitness and Wellness Services: Data collected during non-clinical fitness and wellness services will be kept strictly confidential but is not subject to the same statutory HIPAA regulations as clinical medical records.
5. Consent to Electronic Communications
RunLife Performance and Physical Therapy utilizes electronic communication for scheduling, training/programming, data analysis, and general correspondence.
Email and Training Platforms: You consent to receive communications regarding your programming, test results, and administrative matters via email and third-party training platforms.
Transmission of PHI: You acknowledge that standard email and training platforms may not be end-to-end encrypted or inherently HIPAA-compliant. By agreeing to these terms, you explicitly consent to the transmission of your training data, test results, and potential PHI (such as injury status, rehabilitation updates, or clinical notes) through email and Final Surge. You understand the risks of unauthorized access associated with electronic communication and willingly accept these risks.
6. Payment, Cancellation, and Refund Policy
By providing your payment information to RunLife (via our secure payment processor, Stripe), you authorize RunLife to securely hold your payment method on file and automatically charge it for recurring subscriptions, scheduled services, and any applicable fees outlined below.
Standalone Appointments (Physical Therapy Sessions and Fitness/Metabolic Assessments/Tests):
Payment: A non-refundable deposit is due at the time of booking, with the remaining balance due in full at the time of service. There are no refunds for services once they have been rendered.
Cancellations and No-Shows: We require a minimum of 24 hours' notice to cancel or reschedule any in-person appointment. If you cancel with less than 24 hours' notice or fail to show up for a scheduled appointment, your non-refundable deposit will be forfeited to cover the cost of the reserved time.
Coaching Subscriptions:
Month-to-Month Coaching Subscriptions: You may cancel your monthly coaching subscription at any time prior to your next billing date. RunLife does not offer prorated refunds for partial months already paid.
Subscriptions with a Minimum Commitment Period: RunLife may include certain assessment/testing services (e.g., VO2 max testing, biomechanical analysis) or clinical services (e.g., physical therapy) as part of its upper-tier coaching packages. We may also offer promotional subscription rates in exchange for a minimum commitment period. If you cancel your subscription prior to your final monthly payment of the minimum commitment period, you will be subject to an Early Termination Fee. This fee is equal to the current listed retail value of any included services already rendered, plus the difference between the standard monthly subscription rate and the discounted rate received for active months. You explicitly authorize RunLife to charge this Early Termination Fee to your card on file upon early cancellation.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the appropriate courts located in or serving Jackson County, Georgia.
8. Acknowledgment
By signing or by checking the required electronic consent box upon scheduling or onboarding, you acknowledge that you have carefully read, fully understand, and voluntarily agree to be bound by these Terms and Conditions.
